Welcome to gardentutor.com (the “Site”), a how-to-garden educational Website that is owned and operated by Botaniworld, LLC (“Botaniworld,” “We,” “Us,” or “Our”). The Site and any services made available to you on this Site (collectively, the “Service”) are offered to you by Botaniworld subject to the following terms (the “Terms”). If you access and use the Site, you accept and agree to be bound by and comply with the Terms. If you do not accept the Terms, you may not use the Site. Botaniworld does not sell products or services for children. If you are under the age of 18, you may use the Site only with the consent and involvement of a parent or guardian.

If any portion of these Terms is held to be unenforceable, the unenforceable portion will be construed in accordance with applicable law to the greatest extent possible and the balance of the provisions will remain in full force and effect. These Terms will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and the laws of the United States of America as applicable therein, without giving effect to any principles of conflicts of laws. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to the Terms or your use of the Site will be the state or federal courts located in the Commonwealth of Massachusetts, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

The Site is owned and operated by Botaniworld, and any content viewed through the Site, is for your information, education and communication solely for your personal and non-commercial use. With your Garden Tutor course purchase, We grant you a limited, non-exclusive, non-transferable license to access the Garden Tutor content and view your course(s) through the Service for that purpose. Except for the foregoing limited license, no right, title or interest in the Service or the Garden Tutor content shall be transferred to you. You agree not to use the Service for public display or performances and unless otherwise expressly authorized herein or by an officer or authorized agent of Botaniworld in writing, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.
You may not use the Site for any purpose that is unlawful or prohibited by the Terms. You may not use the Site in any manner that could damage, disable, overburden or impair any Botaniworld server or the network connected to any Botaniworld server, or interfere with any other party’s use and enjoyment of the Site. You may not attempt to gain unauthorized access to Botaniworld information or the Service, other accounts, computer systems or networks or to any Service provided by Botaniworld through hacking, password mining or any other means. 4) Communications with Botaniworld
When you visit the Site or send e-mail to Us, you are communicating with Us electronically. You consent to receive communications from Us electronically. We will communicate with you by e-mail. Modifications to the Service or accounts: Botaniworld reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Botaniworld will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. We have no obligation to retain any of your account information or any content you submit to Us via the Site for any period of time beyond what may be required by applicable law.
6) Refunds
If you are not satisfied with the Service within the first 30 days after purchase, Botaniworld will refund the full amount of your purchase and subsequently terminate your access. Refunds are not available for customers more than 30 days after a purchase. Refunds are not available for accounts which have violated the terms of Service; violations are determined at Botaniworld’s sole discretion. If Botaniworld determines that you are abusing Our refund policy, We reserve the right to suspend or terminate your account and refuse or restrict any and all current or future use of the Service without delivering a refund. 7) No Warranties; limitation of liability and Non-accredited Disclaimer

Our liability (and the liability of each of Our affiliates, and each of Our respective owners, members, managers, employees, licensors, suppliers, partners, and agents) to you or any third parties under any circumstance is limited to the greater of one hundred dollars ($100) or the amount you have paid us in the twelve (12) months before the event giving rise to your claims. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. 8) Indemnity
You agree to defend, indemnify, and hold harmless Botaniworld, its affiliates, and their respective employees, contractors, officers, directors, members, managers, partners, and shareholders (each an “Indemnitee”) from and against all liabilities, claims, and expenses, including attorneys’ fees, that arise from your use or misuse of the Site. 9) Class Action Waiver
You agree that you may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. 11) User-Generated Content
From time to time, some of the content displayed on the Site may be submitted, transmitted, posted, or otherwise provided by you or other users of the Site over whom Botaniworld exercises no control (“User-Generated Content”). Such users are solely responsible for any User-Generated Content displayed on the Site. Botaniworld disavows responsibility for User-Generated Content to the extent permitted by law, and has no obligation to screen any User-Generated Content in advance. Botaniworld may in its sole discretion at any time remove or alter any User-Generated Content or take any other actions with respect to such User-Generated Content. Botaniworld has no liability or responsibility to users for performance or nonperformance of such activities. From time to time, the Site may provide you an opportunity to communicate with Botaniworld to provide User-Generated Content or other information that specifically concerns how Botaniworld can improve the Site and/or the Service or can be used by Botaniworld for such purposes (collectively, “Feedback”). Please be aware that any Feedback communicated to Botaniworld through the Site or otherwise, whether such Feedback consists of suggestions, ideas, graphics, or other material, will be treated as nonconfidential and nonproprietary.
